The Process

Although each civil action involving sexual abuse is unique, most share these traits:
Gathering evidence takes time and hard work – a lawsuit may require two years or more to settle
Due to the statute of limitations for filing suits, the time to start is now (but never assume you have waited too long).
Cases are usually taken on a contingency basis, meaning that Seth is only paid a fee if he is successful in obtaining a monetary award for you. As a result, he is only able to accept cases that he believes he can win. Key factors in undertaking a claim include:
  • Clarity of your memory of the abuse
  • Likelihood of locating witnesses or other victims
  • Existence of additional evidence of the abuse
  • How long ago the abuse occurred
  • Existence of institutional defendants
  • Outrageousness of conduct (acknowledging that all sexual abuse is outrageous)
  • Whether any judgment is likely to be collectable
